General terms and conditions
- SUBMISSIONS
1.1 Before confirming the order, the Buyer has read the instructions for measurement, installation, warranty and maintenance.
1.2 The specification of the order shall specify: the name of the stone, the surface finish, thickness, dimensions and quantity, edge finish, shape and openings.
1.3 Samples and photographs of stone materials are for illustrative purposes only and actual products may differ from those shown (see point 8).
1.4 All special agreements approved by the Seller must be in writing.
2. TARGET
2.1 The delivery time indicated in the quotation is indicative and may vary according to the supply chain situation.
2.2 The Seller shall inform the Buyer of changes in the delivery time as soon as they occur. If the Seller has informed the Buyer in advance of possible delays, the Seller shall not be liable for any costs incurred by the Buyer or other parties.
2.3 If an invoice for advance payment has been issued to the Buyer, the calculation of the delivery time starts from the date of receipt of the advance payment.
2.4 If an order confirmation has been issued to the Buyer, the delivery time shall be deemed to be as set out in the confirmation, unless otherwise agreed.
3. ORDER ACCEPTANCE
3.1 The Buyer is obliged to accept, check and sign the delivery note confirming that the order meets the requirements, unless otherwise agreed.
3.2 The Seller has the right to consider the order as accepted even if the Buyer has not signed the delivery note, but the Seller has the proof of delivery of the order.
3.3 If the Buyer refuses to accept the order, the Buyer shall still be obliged to pay for the order in full, after which the ownership of the product shall pass from the Seller to the Buyer.
4. GUARANTEE
4.1 If the Buyer has any complaints about the delivered order, he must submit them in writing with supporting evidence (e.g. pictures, videos). If necessary, the Seller may ask for additional information or send his staff to check the defects.
4.2 Complaints must be submitted within a reasonable time.
4.3 Warranty conditions are available on the Seller's website.
5. PAYMENT TERMS
5.1 By paying the deposit or confirming the order, the Buyer shall be deemed to have accepted the Seller's General Terms and Conditions and the order specification shall be deemed to meet the Buyer's requirements.
5.2.The final invoice must be paid prior to acceptance of the ordered goods or prior to commencement of installation.
5.3 In the event of late payment of invoices and failure to comply with reminders, the Seller has the right to refer the claim to the relevant institutions.
5.4 If the payment is late, the Seller is entitled to charge a late payment interest of 0.066% per day. In the event of a dispute, the Buyer is still obliged to pay the invoice within the due date.
5.5 If the Buyer fails to pay the invoice or refuses to do so (including in the event of a complaint), the Seller has the right to reclaim the delivered order.
5.6. Vdisputes will be settled by arbitration in accordance with Estonian law.
6. RIGHT OF WITHDRAWAL
6.1 The right of withdrawal does not apply to custom-made products made to the Buyer's dimensions and/or specifications.
6.2 Specially manufactured products include all products which have been processed by the Seller in order to adapt the raw material to the Buyer's requirements.
7. MEASUREMENT AND INSTALLATION
7.1 The Buyer or his representative shall be present during the survey carried out by the Seller and shall provide the necessary information on any changes or additions.
7.6 The drawing based on the measurement shall be submitted to the Purchaser for approval. The Buyer shall check the order specification and the drawing for conformity with the latest modifications and confirm the order.
7.2 If the Buyer wishes to cancel the order after the survey but before the start of production, the Buyer shall be invoiced for the survey work.
7.4 The Seller shall not carry out the following works during the installation unless agreed in writing:
7.4.1. Dismantling of existing work surfaces.
7.4.2. Siliconing between the work surface and the wall if the walls are rough or of soft material.
7.4.3. Electrical and plumbing work.
7.5 If the conditions set out above are not met, the Seller shall be entitled to refuse to carry out the surveying and installation works. Any additional costs shall be borne by the Buyer.
8. STONE SURFACE PROPERTIES
8.1 The Seller uses natural stone materials, which may result in variations in tone and pattern on the flat surfaces.
8.2 The following characteristics may occur on the surface of stone materials:
8.2.1. Small air bubbles (visible as bright spots).
8.2.2. Small spots (visible as cracks).
8.2.3. Structural differences (visible as stains).
8.2.4 Other deviations in colour and pattern tone, if the dimensions of the pieces do not allow them to be produced from a single panel.
8.3 Weight of material per m2:
- 30mm natural stone: 90 kg
- 20mm Silestone and Dekton: 50 kg
- 12mm Silestone and Dekton: 30 kg
8.4 Basic tolerances on the dimensions of details within the tolerances:
- length and width of detail ±2 mm
- Hole dimensions ±1,5 mm
- Stone surface curved up to 2 mm
- angles ±0,3°
8.5 Level thickness
- 30 mm Natural stone ± 2 mm
- 12 and 20 mm Silestone, Dekton ± 1 mm
NB! Thicknesses of two adjacent parts are offset, with a tolerance of ±0.2 mm.
8.6 Technological stock in the form of liners:
- There is a 1-3mm gap between the flat surfaces and the walls.
- The gap between the stones is 1-2mm
- 2-4 mm between the backsplash and the upper cabinets
- Stone overhangs from cabinet 2-20 mm
